Berry wants to obtain an extension of the emergency protection order a judge put in place against the male model after the fight on Thursday.
The violent incident went down on Thanksgiving Day when Gabriel was returning their four-year-old daughter Nahla to Halle Berry’s home.
Aubry and Halle’s fiance Olivier Martinez got into a nasty brawl, which landed Gabriel in the hospital.
Now Halle, 46, is headed to court this week to ask a judge to extend the emergency protective order that will expire on Tuesday.
If the judge grants the restraining order, Gabriel would not be allowed to see his daughter for a specified time.

Gabriel Aubry seemed to lose the fight after taking a swing at Olivier Martinez, winding up with facial contusions and a broken rib.
Martinez reportedly injured his hand during the fight.
Earlier this month, a judge ruled that Berry would not be allowed to move to France with her daughter Nahla, where the actress had hoped to reside with her French actor fiance.
Aubry is scheduled to appear in court on Dec. 13 on a charge of misdemeanor battery.
