To whom it may concern,

I am writing to request that you update and/or remove the webpage, dated April 28, 2008. The headline reads: “Cheri Oteri’s dad murdered by Richard Fagan”. On behalf of myself, the Oteri family, Broadminded Music Publishing Company and the memory of Gaetano Thomas Oteri,
we issue the following statement:

STATEMENT:
The charges against Richard Fagan were dropped as of January 22, 2009. The cause of death was a heart attack.
Tommy Oteri, the son of Gaetano Thomas Oteri, told the D.A., quote: “I speak for the whole family. We believe it was an accident, and we don’t want him to be prosecuted.”
Richard Fagan, Tommy Oteri and Bridgette Fox will be carrying on Tom Sr.’s legacy with Broadminded Music, LLC, (BMI). Richard Fagan is back to writing songs… Songs that would make his friend, Gaetano “Tommy” Oteri proud.
